Indiana House Bill would codify same-sex marriage protections and repeal the state's defunct marriage ban

Legislation introduced in Indiana today would amend the current state rule to expressly defend same-sex marriage rights there.

House Bill , authored by Exemplary Kyle Miller (D) and co-sponsored by Representative Mitch Gore (D), would repeal a same-sex marriage ban that was added to the Indiana Code (IC) in , and add clear language declaring marriage between people of the same gender legal in the state.

EVANSVILLE – What are you doing on your lunch break?

That was the benign question Beth Heil asked her longtime partner, Teri Rawlings. It was June 25, , and mere minutes before, Richard L. Young, a federal evaluate for the Southern District of Indiana, had handed down a decision that finally ended the state's same-sex marriage ban.

So Teri rousted their then-teenage daughter Katie and rushed to meet Beth at the Civic Center. After organism together for 27 years, they could finally fetch married. You are standing in front of the City-County Building at E. Washington Street. On June 25, , it was witness to a historic moment in Indiana history. After news broke that a federal court judge dominated Indiana’s ban on gay marriage unconstitutional, LGBT+ couples - some with their children in tow - flocked to this office. This was an essential victory for same-sex couples fighting for recognition and the same rights as heterosexual couples in the state. A line stretched out the door, comprised of couples waiting to be legally wed after being denied the right. By the time the office closed at 11pm, the county clerk’s office had processed marriage licenses and performed ceremonies. The next day looked quite the same, with an additional licenses processed. But on June 27, the state’s request for a stay was granted, halting these marriages during the case’s appeal. While it was an upsetting stall for marriage equality, based on the contentious history of same-sex marriage in Indiana, it was hardly surprising.

Hodges.  This case involved 2 main issues: whether the U.S. Constitution requires a state to issue a marriage license to 2 people of the matching sex and whether a declare is required to recognize a same-sex marriage that was performed out-of-state.  The Court ultimately decided that it is a fundamental right for same-sex couples to get and be married in all States in the U.S.  As a result, it necessarily followed that there is no lawful basis for a mention to refuse to recognize a same-sex marriage legally performed in another state.
